1. Acceptance of Terms

By accessing or using GymBruhs, operated by J5 Productions LLC ("GymBruhs," "the App," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

 

2. Eligibility and Geographic Availability

You must be at least 13 years of age to use GymBruhs. By using the App, you represent and warrant that you meet this age requirement.

Geographic Restriction: GymBruhs is currently only available to users located in the United States. By creating an account, you represent and warrant that you are physically located in the United States. We reserve the right to restrict access to the App based on geographic location. Users outside the United States may join our waitlist to be notified when service becomes available in their region.

 

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

Provide accurate, current, and complete information during registration

Maintain and promptly update your account information

Keep your password secure and confidential

Accept responsibility for all activities that occur under your account

Notify us immediately of any unauthorized use of your account

 

4. Subscription and Payments

GymBruhs offers both free and premium subscription tiers. By subscribing to a paid plan:

You authorize us to charge your payment method on a recurring basis

Subscriptions automatically renew unless cancelled before the renewal date

Refunds are handled in accordance with applicable app store policies

Prices may change with reasonable notice provided to subscribers

Free trial periods, if offered, convert to paid subscriptions unless cancelled

 

5. User Content

You retain ownership of content you submit to GymBruhs, including workout data, photos, and messages. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for operating and improving the App. You are responsible for ensuring your content does not violate any laws or third-party rights.

 

6. Prohibited Conduct

When using GymBruhs, you agree not to:

Violate any applicable laws or regulations

Harass, bully, or intimidate other users

Post inappropriate, offensive, or harmful content

Impersonate any person or entity

Attempt to gain unauthorized access to the App or other users' accounts

Use the App for any commercial purpose without authorization

Interfere with or disrupt the App's functionality

Collect user information without consent

Upload malicious code or content

 

7. Health and Fitness Disclaimer

GymBruhs is designed to help you track and plan your workouts, but it is not a substitute for professional medical advice, diagnosis, or treatment. Before starting any fitness program:

Consult with a qualified healthcare provider

Listen to your body and exercise within your limits

Understand that workout suggestions are general guidance, not personalized medical advice

We are not responsible for any injuries or health issues that may result from following workouts tracked or suggested through the App.

 

8. Intellectual Property

The App, including its design, features, content, and branding, is owned by J5 Productions LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our express written permission.

 

9. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their respective terms and policies.

 

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

 

11. Limitation of Liability

To the maximum extent permitted by law, J5 Productions LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding any claim.

 

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

 

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in Spokane County, Washington. By using the App, you consent to the exclusive jurisdiction of these courts.
